TERMS OF USE:

Sunburst Software Solutions, Inc. grants you a non-exclusive license to use this copy of the program subject to the following terms, conditions, and the proprietary notices, labels or marks on the program and the accompanying documentation.

You may:
1. Use this program only for the Company or Companies that have been granted a license by Sunburst Software Solutions, Inc.
2. Make a copy of the program in machine-readable form for archival purposes as long as all proprietary notices are reproduced on each copy.

You may not:
1.  Modify, translate, reverse engineer, decompile, disassemble, or create derivative works based upon this program.
2.  Rent, transfer or grant any rights in this program or accompanying documentation in any form to anyone else without the prior written consent of Sunburst Software Solutions, Inc.
3.  Remove any proprietary notices, labels or marks on the program or accompanying documentation.
4.  Use this program, or permit this program to be used, for Companies that are not granted a license.

This software product is provided "as-is" and Sunburst Software Solutions, Inc. makes no warranty, either express or implied, including but not limited to, warranties of correctness and fitness for a particular purpose. In no event will Sunburst Software Solutions, Inc. be liable for any indirect, special, consequential or other damages however caused by the software or data produced by it.

The software has been designed to operate on hardware with Microsoft(r) Windows(r) 95, 98, NT(r), 2000 and XP(r) based operating systems. Sunburst Software Solutions, Inc, shall have no responsibility for use of the Program in conjunction with other hardware or other operating systems.

The responsibility for testing for "viruses" shall be yours. Sunburst Software Solutions, Inc. applies virus testing to the software product before it is released, but cannot guarantee that diskettes or CD's are virus free of random strains, new evolutions not yet detectable, or inadvertent infections.

This license is not for sale and it may not be assigned or sublicensed to anyone else. Title and copyrights to the program and the accompanying documentation and any copies remain with Sunburst Software Solutions, Inc.

Any violations of this license agreement will subject the violator to injunctive relief in the State of Vermont, County of Orleans. You agree to submit to jurisdiction in the Orleans County Court and by acceptance of the Sunburst Software Solutions, Inc. products, agree not to contest or dispute venue or jurisdiction of the action. Acceptance of this license agreement is acknowledged when you enter a license code for your software. You further understand that Sunburst Software Solutions, Inc. is entitled to seek both injunctive relief and damages for proven violation of this license agreement in said Court. The prevailing party in any such action will be entitled to recover attorney fees and cost disbursements. Sunburst Software Solutions, Inc. has the right to an automatic temporary, preliminary, and permanent injunctive relief from said Orleans County Court, in the case of a breach or any wrongful use of this license agreement.

If you do not comply with any of the above restrictions, this license will terminate, you will be liable to Sunburst Software Solutions, Inc.  for damages or losses caused by your non-compliance and Sunburst Software Solutions, Inc. will be entitled to a court order, which will require you to comply.

This agreement is the entire agreement. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect.

If you do not agree to the above terms, you must discontinue any further use of this product and return to Sunburst Software Solutions, Inc. any material (including any copies), which Sunburst Software Solutions, Inc. has sent to you in connection with this product.

Return Policy:

Product returns are not fun for anybody, and we try to do everything we can to keep them to a minimum.  Because we already know that all the products work as represented, the most common reason for a return would simply be that the software did not fit your needs.  Therefore, we encourage you to carefully review the Product Detail pages for the software you are interested in, and view the appropriate on-line product demonstration presentation available on this website before you make your purchase.  In addition, you are encourage to call us to discuss any product that you are interested in but still have questions about.  We'll be pleased to answer any questions and engage in an in depth discussion about how the products work and how they might be of benefit to you.

Since we offer a trial version of our software before any money is spent, returns are expressly prohibited.  No Refunds under any circumstances.

DEFECTIVE CD'S
Defective CD's sometimes happen, and will promptly be replaced by Sunburst Software Solutions, Inc. upon notification by the customer.  ALL Replacement CD's will be shipped Priority Mail through the US Postal Service.


NOTICE:
This return policy has become part of our End User License Agreement, effective August 1, 2003 to comply with VISA & MasterCard mandates that require proof of Return Policy Disclosure for all sales.  Our End User License Agreement is displayed on our website, enclosed in printed form as part of our software manuals, and must be accepted prior to the ability to fully download and/or install the software; and as such constitutes signed proof of prior disclosure of the policy.

QuickBooks Version Our products only work with Pro/Premier or Enterprise versions of QuickBooks. This includes the Premier Contractor, Enterprise Contractor, Premier Manufacturing ....please be specific [and correct] different versions of our products work with QuickBooks. For Industry Specific Versions of Premier or Enterprise that are not listed - select the Version and/or year: i.e. 2005 Premier or Enterprise 5.0. If you are using a QuickBooks version not listed in the drop down menu, please contact us for compatibility status. See product detail pages for CPS, CAPS and WMS that have specifics.

Microsoft Word/Excel Version Microsoft Word and Excel are required for Certified Payroll Solution and Construction Application for Payment Solution. Wage Manager does not require Word or Excel.

All orders will be shipped within 2 business days of receipt of payment and/or order. Almost always orders received before 2:00 pm EST are shipped the same day, with other orders shipping the following business day.

Electronic download orders will be fulfilled by our staff after receipt of payment, during normal business hours. You will receive your license and download information directly from us via email. We must issue your license and enter you into our database in order for you to download the program. Our normal business hours are: Monday - Friday, 9 am to 6 pm EST.

Express mail orders, please note: The U. S. Postal Service will attempt to deliver Express Mail packages Sundays and Holidays. If no one is available to accept receipt, a note will be left with a phone number to call. If you do not wish for weekend or holiday delivery, please specify in the Special Instructions above.
